1Introduction & Acceptance of Terms

Welcome to the online store of "Wadaa Dates," the brand owned by Wadaa Al Dhahabiya Company ("the Company," "we," "Wadaa"). This document governs the terms and conditions for using and purchasing from the website ("the Site"). Your use of the Site or completion of any purchase constitutes your explicit agreement to all terms set out below.

If you do not agree to any provision of these terms, please refrain from using the Site or completing any purchase through it.

3Scope of Service

The Site allows customers to browse and purchase Wadaa Dates products for delivery within the Kingdom of Saudi Arabia (and internationally where international shipping is available), with secure electronic payment and an approved electronic tax invoice provided.

4User Account

• Shopping is available as a guest or through creating an account that includes name, email address, mobile number, and shipping address.
• The customer is responsible for keeping their login credentials confidential and not sharing them with others.
• The Company reserves the right to suspend or cancel any account used in violation of these terms or applicable regulations.

5Products & Pricing

• All prices displayed are in Saudi Riyals and inclusive of VAT unless explicitly stated otherwise.
• The Company strives to display accurate product images and descriptions; however, actual colors and shapes may vary slightly due to the handmade nature of the food product.
• The Company reserves the right to modify prices or product availability at any time without prior notice, provided this does not affect previously confirmed orders.
• If a product becomes unavailable after order confirmation, the customer will be notified and the value of the unavailable product will be refunded or replaced per their preference.

6Ordering & Payment

• An order is considered final once confirmed and successfully paid for through one of the payment methods available on the Site (mada/Visa/Mastercard, Apple Pay, or other approved methods).
• The Company issues an electronic tax invoice for every purchase in accordance with the requirements of the Zakat, Tax and Customs Authority (ZATCA), and a copy is sent to the customer via email.
• The Company does not store payment card data; payments are processed through a licensed, approved electronic payment gateway in the Kingdom.
• The Company has the right to cancel any order suspected of being linked to fraud or regulatory violation, with notice to the customer and a refund of the amount paid.

7Shipping & Delivery

• Delivery service covers regions of the Kingdom of Saudi Arabia, with potential future expansion to international shipping.
• Estimated delivery time and shipping cost are determined at checkout, and may vary depending on geographic region.
• Given the heat-sensitive nature of some food products (such as chocolate-covered items), appropriate packaging and cooling methods are used during shipping in hot conditions.
• Responsibility for the product transfers to the customer upon successful delivery to the address specified in the order.

8Exchange & Return Policy

The return and exchange policy is subject to the provisions of the Saudi E-Commerce Law and its executive regulations, taking into account the special nature of food products:

• As Wadaa Dates products are perishable, consumable food items, they fall within the exceptions to the customer's right to return without cause typically afforded for non-food goods, in order to preserve food safety for other customers.
• The customer has the right to request an exchange or full refund of the product value if they receive a damaged, expired, or non-conforming product, within 48 hours of receipt, with supporting photos attached.
• Every return request is reviewed by the Quality team, and the customer is notified of the decision within 3 business days.
• If a return is approved due to a product defect, the Company bears the cost of return shipping.
• Return requests are not accepted for a mere change of mind after the packaging has been opened, in order to uphold food safety standards.

9Intellectual Property

• All trademarks, logos, designs, and textual and visual content displayed on the Site are exclusively owned by Wadaa Al Dhahabiya Company, and may not be copied or used without prior written permission.
• Reproducing, distributing, or using any content from the Site for commercial purposes without the Company's consent is prohibited.

10Acceptable Use of the Site

• The customer agrees to use the Site for lawful purposes only, and not to attempt to hack or damage it in any way.
• Using misleading information or impersonating others when placing orders is prohibited.

11Limitation of Liability

• The Company makes every effort to ensure the accuracy of information displayed on the Site, but is not liable for any incidental technical errors beyond its control.
• The Company is not liable for any delivery delays resulting from force majeure (natural disasters, government closures, shipping company disruptions).
• Customers with sensitivities to nuts, chocolate, or any other ingredients are asked to carefully review the food label before consumption.

12Governing Law & Dispute Resolution

• These terms and conditions are governed by and interpreted in accordance with the laws of the Kingdom of Saudi Arabia.
• In the event of any dispute, both parties are encouraged to seek an amicable settlement first.
• The customer has the right to file a complaint through the "Istrdad" platform of the Ministry of Commerce for resolving e-commerce disputes, or to resort to the competent judicial authorities in the Kingdom if an amicable resolution cannot be reached.

13Amendments to the Terms

The Company reserves the right to amend these terms and conditions at any time, and amendments take effect immediately upon publication on the Site. Customers are advised to review this page periodically.
